Ah, gotta love 4th amendment cases. They invariably lead to unusual splits like the one in this case.

I continue to loathe Stephen Breyer, his vote in Bush v. Gore notwithstanding. I mean his comments from the bench in this case ... oy. And Kennedy's disgust with drugs really does make you wonder exactly what sort of life-changing event happened to him to make him become an authoritarian Helen Lovejoy on the matter. And of course the fact that Roberts and Alito are on the Court at all is a reminder of how disappointing a lot of Democrats, like Robert C. "Big Daddy" Byrd, are. At least there's Ginsburg, and on a handful of votes, Scalia.

It's worth noting that a crim defense attorney buddy of mine was completely indifferent about this case. There's probably nearly complete overlap, his point seemed to be, between evidence of a crime and weapons, not because they are in all cases the same, but because in most justifiable stops from which an arrest results, both will be at least reasonable for the police to assume. Which is to say, said friend suspects that it's a nice symbolic retreat from a particular, narrow fourth amendment doctrine that always looked asinine on its face, but that there's not much there of real substance.
