This is not a distraction we need at this precise moment. Re Souter, does he have a traditional time for hiring, and if so, how far passed it are we? I think one of the Conspirators picked Souter as the favorite to step down this year months ago -- before the general election.

And yes, Souter does usually hire last. That said, Ginsburg and Breyer have already made some of their hires for the Fall '10 term, while Souter hasn't hired for a year earlier.
